Hyderabad: The Telangana High Court has issued notices to MLA Danam Nagender and the Speaker acting as tribunal in connection with a disqualification case, marking a fresh development in the ongoing legal dispute.
The court was hearing a petition filed by BJP Legislature Party leader Aleti Maheshwar Reddy, who challenged the Speaker decision to dismiss the disqualification plea against Nagender. The petitioner argued that the decision was legally flawed and required judicial review.
During the hearing, the bench led by Chief Justice Apresh Kumar Singh and Justice G M Mohiuddin examined the arguments presented by the petitioner counsel. It was contended that the Speaker order failed to properly consider key legal aspects and previous court rulings.
The petitioner pointed out that Nagender, who was elected as an MLA from one party, later contested parliamentary elections from another party and also campaigned against his original party. This, according to the petitioner, was sufficient ground for disqualification without further evidence.
It was also argued that earlier delays in deciding the disqualification petition had led the matter to reach the Supreme Court. Based on those directions, the Speaker had eventually taken a decision, but the petitioner claimed that the final order did not align with legal principles.
The High Court bench, after hearing initial submissions, issued notices to Danam Nagender and sought responses in the matter. The hearing has been adjourned and is scheduled to continue on April 16.
The case is expected to draw further attention as it raises questions on the interpretation of disqualification rules and the role of the Speaker in such matters.
