In a significant development for government employees, the Telangana High Court has directed the state to implement the Old Pension Scheme for those recruited through notifications issued before September 2004. The ruling brings clarity to a long standing dispute over pension eligibility.
The division bench made it clear that employees who entered the recruitment process under the Old Pension Scheme cannot be shifted to the Contributory Pension Scheme simply because their appointments were delayed. The court observed that the basis of eligibility must be the recruitment notification date, not the appointment date.
The order came after a petition filed by employees working in various courts across districts such as Mahabubnagar, Nizamabad and Ranga Reddy. The petitioners argued that they had applied and completed the selection process when the Old Pension Scheme was still in force, making it unfair to place them under a different system later.
Taking note of these arguments, the High Court ruled in favour of the employees and instructed the government to extend the Old Pension Scheme benefits accordingly. The bench also set a clear deadline of June 10, 2026, for implementation.
In a strong warning, the court stated that failure to follow its directions would result in contempt proceedings. Senior officials, including top representatives from the Law and Finance departments, have been asked to appear in person if the order is not executed within the stipulated time.
While the case directly involves a group of employees from the Law Department, its impact is expected to be much wider. Thousands of employees across multiple government sectors, including power utilities and other departments, are likely to benefit from this decision.
The judgment is seen as a major relief for employees who have been seeking recognition of their rightful pension benefits for years, and it may pave the way for broader implementation of the Old Pension Scheme in Telangana.
