The Telangana High Court has dismissed a petition challenging the KGBV bunker bed tender process, stating that there was no evidence of irregularity or unfair practices in the decision taken by the state government.
The case revolved around the supply of 45360 bunker beds along with mattresses and pillows to Kasturba Gandhi Balika Vidyalaya schools. Petitioners questioned the extension of the deadline through supplementary agreements, arguing that a fresh tender should have been issued instead.
However, the state government clarified that the tender conditions clearly allowed for extensions and penalties in case of delays. It also pointed out that the petitioners had not participated in the tender process, raising questions about their right to challenge it.
After reviewing all submissions, the court observed that there was no proof of arbitrariness or mala fide intent in the process. It noted that certain delays occurred due to the time taken in finalizing specifications, including design and colour requirements.
The court further emphasized that supplementary agreements made under existing tender conditions are contractual and legally valid. Since the original terms permitted time extensions, the government’s decision did not violate any rules.
A key observation by the court was that parties who do not take part in a tender generally cannot question its outcome. This principle played a crucial role in the dismissal of the petition.
With these findings, the court concluded that there was no legal flaw in the KGBV bunker bed tender process and rejected the plea, providing relief to the state government.
